Welcome to Kashlei! These Terms of Service (“Terms”) govern your access to and use of the Kashlei website, mobile applications, services, and software (collectively, the “Service” or “Kashlei”), provided by Neon Sky Group (“Neon Sky Group,” “we,” “us,” or “our”).

By creating an account, accessing, or using Kashlei, you agree to be bound by these Terms and our Community Guidelines and Privacy Policy. If you do not agree to these Terms, do not use or access the Service.

1. Eligibility & Account Creation

Age Requirements: You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Kashlei. If you are under the age of majority in your jurisdiction, you may only use Kashlei under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at support@kashlei.com if you suspect any unauthorized access or security breach.

Accurate Information: You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

2. Content & Intellectual Property Rights

Your Content: You retain all ownership rights to the photos, videos, text, messages, and other content you create and post on Kashlei (“User Content”).

License to Kashlei: By posting or sharing User Content on or through the Service, you grant Neon Sky Group a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content solely for the purpose of operating, improving, promoting, and developing Kashlei.

Content Removal & Safety: We reserve the right, but have no obligation, to review, monitor, or remove any User Content that violates these Terms, our Community Guidelines, or applicable laws, or that we deem harmful to the Service or our users.

3. Acceptable Use & Conduct

You agree not to use Kashlei to:

• Violate any applicable local, state, national, or international law or regulation.
• Post or transmit illegal, abusive, harassing, defamatory, vulgar, or hate speech content.
• Infringe upon the intellectual property, privacy, publicity, or proprietary rights of any person or entity.
• Engage in unauthorized commercial communications, spamming, or automated scraping/data extraction.
• Attempt to gain unauthorized access to accounts, servers, or networks, or introduce malware, viruses, or malicious code.

4. Trademarks, Handles & Intellectual Property

Kashlei Rights: The Kashlei name, logos, visual designs, trademarks, and overall software interface are the exclusive property of Neon Sky Group and its licensors.

Account Handles: Handles, usernames, and custom URLs are allocated on a platform-availability basis and do not grant any trademark or property ownership rights. Neon Sky Group reserves the right to reclaim, reassign, or rename account handles for trademark infringement, impersonation, or prolonged account inactivity.

IP Infringement / DMCA: If you believe content on Kashlei infringes your copyright or trademark, please contact our designated rights team at support@kashlei.com.

5. Paid Features, Subscriptions & Creator Monetization

Paid Services & Tips: Kashlei may offer paid features, including paid subscription tiers, one-time content purchases, creator tips, and virtual goods (“Paid Features”). All purchases are final and non-refundable unless required by law or explicitly stated otherwise.

Automatic Renewal: Paid Kashlei plans (Blue Verified, Creator Pro, and Monetized Account) are subscriptions that renew automatically at the end of each billing period (monthly or yearly, as you choose) and are charged to your saved payment method at the price shown before purchase, until you cancel. You can cancel anytime online in Billing; cancellation stops future renewals and your access continues to the end of the period already paid for. See the Monetization Terms.

Creator Monetization: Creators who earn revenue, tips, or subscription income through Kashlei must comply with our Monetization Terms, complete required tax documentation, and adhere to minimum payout thresholds. Neon Sky Group reserves the right to deduct platform processing fees from creator transactions as disclosed at the time of payout.

Payment Processing: Financial transactions are processed by third-party payment providers. By purchasing or receiving payments, you agree to the terms and privacy policies of our payment processors.

6. Advertising & Third-Party Services

Kashlei may display third-party advertisements, sponsored content, and promotional links. Advertising is an optional product configuration and remains disabled until enabled by administrative controls.

Ads will not appear in private account areas, paid catalogs, or administrative tools.

KashAds: Signed-in users may buy self-serve ads for their profile, a post, a section listing, or an external website at a flat daily or weekly price shown before purchase. Prices do not depend on impressions or clicks, which are reported for information only. Ads are labeled “Sponsored”. External links are screened for malicious content and reviewed by moderation before going live; adult links are allowed only for verified adults and only in 18+ areas. Kashlei may reject or remove any ad. A rejected ad, or one canceled before it starts, is refunded to the balance it was paid from; a running ad that is canceled stops immediately and is not prorated.

Kashlei promo $: Promotional balances (“promo $”) have no cash value. They can only be spent on Kashlei items, such as ads, placements, plans, listings, and items sold by Kashlei, and cannot be withdrawn, sold, or exchanged for money. Sellers may choose to accept promo $; promo $ a seller receives stays promo $, can only be spent on Kashlei items, is never withdrawable, and is never reimbursed by Kashlei with real money. Sign-up promo $, when offered, is limited to one per verified person and may be withdrawn if obtained through duplicate or fraudulent accounts.

Advertising partners and third-party services integrated into Kashlei may set cookies or collect data as detailed in our Privacy Policy. Neon Sky Group does not endorse and is not responsible for third-party products or services.

7. Disclaimers & Limitation of Liability

“AS IS” BASIS: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMITTED BY LAW, NEON SKY GROUP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNATIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY OR USER ON THE SERVICE;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL NEON SKY GROUP’S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF $100.00 USD OR THE AMOUNT YOU PAID KASHLEI IN THE PAST TWELVE (12) MONTHS.

8. Governing Law & Dispute Resolution

Governing Law: These Terms, and any dispute, claim, or controversy arising out of or relating to your use of Kashlei, shall be governed by, construed, and enforced in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.

Jurisdiction: You and Neon Sky Group agree that any legal action, suit, or proceeding arising out of or in connection with these Terms shall be instituted exclusively in the state or federal courts located in Clark County, Nevada, and you irrevocably consent to the personal jurisdiction and venue of such courts.

9. Suspension & Termination

We reserve the right, in our sole discretion, to suspend, disable, or terminate your account or access to all or part of Kashlei at any time, with or without notice, for any conduct that violates these Terms, harms other users, or impairs Neon Sky Group’s business interests. You may discontinue your use of Kashlei or close your account at any time.

10. Changes to These Terms

Neon Sky Group may update or modify these Terms from time to time. When material changes are made, we will notify you by updating the “Last updated” date at the top of this page or through an in-app notice. Your continued use of Kashlei after any modifications constitutes your acceptance of the revised Terms.
