KashFans Creator Terms

1. About these terms

KashFans is the 18+ creator subscription section of Kashlei, found at kashlei.com/a. These Creator Terms add to the Kashlei Terms of Service, the KashFans Fan Terms and the KashFans Acceptable Use Policy, which also apply to you.

Each time a fan subscribes, unlocks a pay-per-view post or tips you, a separate contract is formed between you and that fan (the creator–fan contract, described in the Fan Terms). Kashlei runs the platform and processes payments, but is not a party to the creator–fan contract.

2. Who can be a creator: 18+ and identity verification

You must be at least 18 years old (or the age of majority where you live, if higher), have a Kashlei account in good standing and an active Kashlei seller store, and pass Kashlei's identity and age verification. We may ask you to verify again at any time, and we re-check your verification before paying out or renewing a fan's subscription.

You may run only one creator page, and only for yourself. You may not let anyone else operate your page unless you remain fully responsible for everything they do on it.

3. Creator membership: $29.99 per year, auto-renewing

To publish a creator page you must buy the KashFans creator membership. It costs US $29.99 per year, is charged when you sign up, and renews automatically every year at the then-current price until you cancel. We will tell you before any price change takes effect.

You can cancel anytime in Settings. Your page stays live until the end of the year you already paid for, and you will not be charged again. Membership fees are not refunded for partial years, except where the law requires.

Your page is only shown to fans while your membership is paid and your verification is valid. If a renewal can't be collected, your page is taken down after a 7-day grace period, and fans' subscriptions to you stop renewing.

4. Your content and your responsibilities

You are responsible for everything you upload, including captions, messages, your bio and your display name. For every item, you promise that it is lawful, follows the Acceptable Use Policy, is accurately described, and that you have every right needed to post and sell it on Kashlei.

You must keep records proving the age and identity of everyone who appears in your content, and give them to Kashlei promptly if we ask.

5. Consent and releases for anyone in your content

Anyone other than you who appears in your content must be an adult (18+) whose identity and age you have verified, and must have given you written, informed consent (a signed model release) to appear in that content and to have it sold on KashFans. You must keep each release and ID and provide them to Kashlei on request.

If a person in your content withdraws consent, or if you can't provide the release or ID when asked, Kashlei may remove the content, restrict your page and hold related earnings while we review.

6. Who owns your content, and the license you give Kashlei

You keep ownership of your content. You give Kashlei a worldwide, non-exclusive, royalty-free license to host, store, copy, re-encode, resize, display and deliver your content to fans who have access, and to use your public profile details (display name, handle, safe avatar and bio) to list and promote your page on Kashlei. This license lets us run KashFans; it ends when your content is deleted, except for copies we must keep for legal, safety or dispute reasons or that a fan already bought.

Kashlei will not sell your content to other platforms. Fans get a personal, non-transferable right to view what they paid for on Kashlei only; they may not download, share or resell it.

You let Kashlei send copyright or takedown notices on your behalf to sites that copy your content, though we are not required to.

7. Prohibited content

The Acceptable Use Policy lists what can never appear on KashFans. Breaking it can lead to immediate removal, suspension, loss of earnings tied to the breach, and reports to law enforcement where required.

8. Prices, the Kashlei fee, payouts and chargebacks

You set your monthly subscription price and any pay-per-view prices, within the limits shown in Settings. All prices are in US dollars. Fans pay on Kashlei from their KashPay balance; no other payment method or location is allowed.

Kashlei keeps 10% of every KashFans creator sale, including subscriptions and renewals, pay-per-view unlocks and tips. The fee is taken from the sale price, not added on top for the fan. The other 90% is credited to your withdrawable KashPay balance.

You can withdraw earnings using Kashlei's payout methods once your verification is complete and any minimum payout amount is met. Payout providers may charge their own fees.

If a fan's payment is refunded, reversed or charged back, Kashlei may deduct your share of that payment from your balance or future earnings. We may hold earnings we reasonably suspect come from fraud, a breach of these terms, or an unlawful payment while we investigate.

You are responsible for your own taxes and for reporting your KashFans income. Kashlei may collect tax information and issue tax forms where required.

9. No off-platform contact or payments

Every KashFans relationship stays on Kashlei. You may not share, ask for or hint at phone numbers, email addresses, street addresses, links or domains other than kashlei.com, or handles on other apps or payment services (for example Instagram, Snapchat, Telegram, WhatsApp, OnlyFans, Cash App, Venmo or PayPal), including spelled-out or disguised versions such as "five five five" or "gmail dot com". KashFans automatically blocks this information in messages, post captions, bios and display names, keeps a record of each attempt, and flags repeat attempts to Kashlei's safety team.

You may not ask fans to pay you, tip you or meet you anywhere outside Kashlei, or offer to move a conversation off KashFans. Breaking this rule can lead to suspension and loss of the earnings involved.

10. Copyright complaints and takedowns

If you believe content on KashFans infringes your copyright or shows you without consent, report it through Kashlei's copyright and safety reporting tools or our designated DMCA agent. A valid copyright notice identifies the work, the content on Kashlei, your contact details, a good-faith statement and your signature.

We remove content that we are told, in a valid notice, is infringing and may notify the creator, who can send a counter-notice. Repeat infringers lose their creator pages. Reports of non-consensual or underage content are handled immediately and are never subject to counter-notice.

11. Suspension and termination

You can close your creator page anytime. Fans who already paid keep access until the end of their paid period; their subscriptions then stop renewing. Your remaining earnings stay available to withdraw, minus any refunds or chargebacks.

Kashlei may remove content, suspend or close your page, pause renewals, or hold earnings, with or without notice, if we reasonably believe you broke these terms or the law, created risk to fans or Kashlei, or tried to take payments or contact off Kashlei. Where we can, we will tell you why and how to appeal.

12. Disclaimers

KashFans is provided as it is and as available. Kashlei does not promise that the service will be uninterrupted or error-free, that any creator will earn a particular amount, or that content will meet your expectations.

Creators decide what they post and what they charge. Kashlei moderates KashFans but does not create, endorse or guarantee user content, and is not responsible for how other people use content they were able to see.

13. Limits on Kashlei's liability

To the extent the law allows, Kashlei and its owners, staff and agents are not liable for indirect, incidental, special, consequential or punitive losses, or for lost profits, revenue, data or goodwill, arising from KashFans.

To the extent the law allows, Kashlei's total liability to you for all claims about KashFans is limited to the greater of the amount you paid Kashlei (fees, not creator earnings) in the 12 months before the claim, or US $100. Nothing in these terms limits liability that cannot be limited by law.

You agree to cover Kashlei's reasonable losses and costs (including legal fees) caused by your breach of these terms or by content you upload.

14. Governing law and disputes

These terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-law rules. Courts located in Clark County, Nevada have jurisdiction over any dispute, unless mandatory consumer law where you live gives you a different right.

Before starting a claim, please contact Kashlei support and give us 30 days to try to resolve it informally. Claims must be brought within one year after they arise, where the law allows.

15. General

If part of these terms can't be enforced, the rest still applies. Kashlei not enforcing a term is not a waiver. You may not transfer your rights under these terms; Kashlei may transfer them as part of a reorganization or sale. These terms, together with the Kashlei Terms of Service, Privacy Policy and Community Guidelines, are the whole agreement about KashFans.

We may update these terms. For material changes we will notify you in the app before they take effect; creators must accept a new Creator Terms version before posting or selling again.
